Online Voting closes. September, Tuesday 19.

The Constitution and Bylaws Committee has proposed the following motions to change the Constitution and Bylaws and Policy Manual as indicated.  This will be an online ballot.  The Voting Center will open on the website September 3, 2017 at 0800 PST and close September 19, 2017 at 1700 PST.  All Members are encouraged to vote.  
These changes are proposed now in order to effect change prior to the Officer Nominations at the October General Meeting and upcoming Elections.  
Red text indicates a proposed change.  Underlined text is proposed to be added and struck through text is proposed to be removed.

Motion to add this section to the Policy Manual.  This will add a clear timeline for union publication of members Ballot Publications:
 
Ballot Related Publications


"Pro" letters may be submitted to the Secretary (or the Secretary’s appointee) by any members in good standing no less than 96 hours prior to the opening of the voting center or the mailing of the ballots.  If the maker of the motion being considered submits a letter their submission will be listed first in viewing order. Opposing "Con" letters may also be submitted to the Secretary (or the Secretary’s appointee) by any member in good standing no less than 96 hours prior to the opening of the online voting center or mailing of the ballots.  If more than one letter is submitted they will be listed for viewing in the order received. The Local will publish letters on the website (voting center of online ballot and in the Members Section for mailed ballots) and email them to the membership no less than 48 hours prior to the opening of the online voting center or mailing of the ballots.  No authors names will be included on the letters.  If only one letter is submitted by either side then only that will be posted and emailed by the Local.  Members interested in submitting letters are recommended to contact the Secretary to ask if similar letters to their viewpoint have already been submitted, and are encouraged to coordinate with members expressing the same viewpoint.


For Elections a single candidate letter may be submitted to the Secretary (or the Secretary’s appointee) for each candidate no less than 96 hours prior to opening of the voting center or mailing of the ballots.  Candidate letters will be emailed to the membership and posted in the members section of the website in the order they will appear on the ballot, with incumbents listed first then other candidates list order determined by random drawing (Constitution and Bylaws Article VIII Section 6B) no less than 48 hours prior to the opening of the voting center or the mailing of ballots.  Candidate letters will not be mailed with ballots or posted in the voting center of the website (Constitution and Bylaws Article VIII Section 4).  A mailing list for the Local may be obtained from the Secretary for each candidate but the cost for any postal mailings is the responsibility of the candidate (Constitution and Bylaws Article VIII Section 3).  If a candidate requests that the Local postal mail their candidate statement (at the full expense of the candidate) they must submit their materials to be mailed within 72 hours of their nomination to the Secretary (or the Secretary’s appointee).


No statements may be made that disrespect another member of the Local and all submissions must comply with the IAFF Code of Ethics.

Motion to change Constitution and Bylaws Article IV Section 4 and Article VIII Section 2 as indicated:  This is a language change only to keep offices in line with election cycles due to the departments recent renumbering of the divisions.
 
 
SECTION 4 – Vice President
 
(A) The Membership at large shall elect Vice Presidents.
 
(a) First Vice President shall be responsible for issues pertaining to Division 1 the West Valley.
(b) Second Vice President shall be responsible for issues pertaining to Division 2 the High Desert.
(c) Third Vice President shall be responsible for issues pertaining to Division 3 the North Desert.
(d) Fourth Vice President shall be responsible for issues pertaining to Division 4 the Mountains.
(e) Fifth Vice President shall be responsible for issues pertaining to Division 5 the South Desert.
(f)  Sixth Vice President shall be responsible for issues pertaining to Division 6 the East Valley.
(g) Eleventh Vice President shall be responsible for issues pertaining to Division 11 Special Operations.
(h) Additional Vice President positions may be created by vote of the Executive Board upon addition of significant union members such as outside agencies joining the Local or additional communities annexing or otherwise contracting services with San Bernardino County Fire Department.  
(i) The VP are responsible for their geographic areas as outlined on Local 935’s website.

SECTION 2 - NOMINATIONS
 
Any Member in good standing may be nominated to more than one office, but a Member may stand for election to only one office, except as provided in the Constitution. A Member nominated to an office who wishes to decline may do so at the regular meeting for nominations or if he/she is not present and wishes to decline, they shall so notify the President or Secretary in writing within ten business days after the close of nominations. A Member nominated to two or more offices must notify the President/Business Manager or Secretary of the office for which he/she chooses to stand for election either at the time of his/her nomination or in writing within ten business days after the close of nominations. If such a nominee fails to notify the President/Business Manager or Secretary to ascertain their choice, their name will not appear on the ballot. A Member nominated and not present at the regular meeting hall be notified by the Secretary of the nominations
 
Nominations for the offices of President/Business Manager, First Vice President, Third Vice President, Fifth Vice President, Eleventh Vice President, Affiliate Division Representatives, Division 2 High Desert Representative, Division Mountain RepresentativeDivision 6 East Valley Representative, and Trustees will be made at the General Membership meeting in the last quarter of each odd numbered calendar year. Nominations for the Offices of Secretary, Treasurer, and Executive Vice-President, Second Vice President, Fourth Vice President, Sixth Vice President, Division 1 West Valley RepresentativeDivision 3 North Desert RepresentativeDivision 5 South Desert Representative, and Division 11 Special Operations Representative will be made at the General Membership meeting in the last quarter of each even numbered calendar year.  Any additional Board positions created by expansion of the union as defined in this Constitution will be placed into odd or even years to maintain an even balance of election terms.

Motion to add to the Constitution and Bylaws Article V Section (G) as indicated:  This adds the language already in the VP and Executive VP sections should the department further expand.
 

(G) Additional Rep positions shall be created by vote of the Executive Board when a new VP position is created upon addition of significant union members such as outside agencies joining the Local or additional communities annexing or otherwise contracting services with San Bernardino County Fire Department.
